This Agreement ("Agreement") governs the use of the [The Appointment App] ("Application"), which is owned and operated by [Digital Amigos], a company registered in India. By using this Application, you ("User") agree to be bound by these terms and conditions.
By accessing or using the Application, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you may not use the Application.
The User acknowledges and agrees that the Application is intended for personal use only and is not to be used for commercial purposes. The User agrees to use the Application in a lawful and responsible manner and to comply with all applicable laws and regulations.
By using [The Appointment App], the User agrees to share their Google user data, including but not limited to their email address, name, phone number, and Google Calendar events, solely with their own explicit and informed consent. The User acknowledges that this data sharing will be initiated and controlled by the User themselves and not by any third party.
The User takes full responsibility for authorizing and permitting the sharing of their Google user data with [The Appointment App]. The User must ensure that any such sharing is done consciously and voluntarily, and that they are the sole decision-maker in granting or revoking access to their Google data.
The User is strictly prohibited from allowing any third party or unauthorized individual to access, use, or share their Google user data on their behalf. The User shall not share their login credentials or otherwise enable unauthorized access to their Google account for the purpose of data sharing through [The Appointment App].
The User acknowledges and agrees that all content and materials on the Application, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are protected by copyright, trademark, or other proprietary rights and laws.
The User agrees to the Application's Privacy Policy, which is incorporated herein by reference. The Privacy Policy sets out the User's rights and obligations with respect to the collection, use, and disclosure of personal information.
The User agrees not to use the Application in any manner that is illegal, harmful, or interferes with the use of the Application by others. The User agrees not to transmit any content that is obscene, defamatory, or infringes upon the rights of others.
The Company reserves the right to terminate the User's use of the Application at any time without notice or liability, for any reason including, but not limited to, violation of these terms and conditions.
The Application is provided on an "as is" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall the Company or its affiliates be liable to the User or any third party for any damages, including without limitation, direct, indirect, incidental, consequential, special, or punitive damages, arising out of or in connection with the use of the Application.
The User agrees to indemnify and hold the Company and its affiliates, officers, directors, and employees harmless from any claims, damages, or expenses, including attorney's fees, arising out of or in connection with the User's use of the Application.
This Agreement shall be governed by and construed in accordance with the laws of India. The User agrees that any legal action arising out of or in connection with this Agreement shall be brought in the courts of Indore, India.
The Company reserves the right to change these terms and conditions at any time without notice. The User's continued use of the Application following any changes constitutes acceptance of the new terms and conditions.
This Agreement constitutes the entire agreement between the User and the Company with respect to the use of the Application and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between the User and the Company.
Specify that the phonebook contact information accessed by the appointment application will only be used for the purpose of scheduling appointments or for any app-related purposes and will not be shared with third parties or used for any other purposes without the user's explicit consent.
